1. SCOPE OF APPLICATION, CONCLUSION OF A PURCHASE AGREEMENT

1.1

These General Terms and Conditions of Business to Consumers ("General Terms and Conditions") apply to all agreements that PATALI ("PATALI" or "we"), a business registered in Australia with registered office at 204 Penguin Road, West Ulverstone, Tasmania, Australia, concludes with a customer ("you") on the basis of online orders via the website of PATALI ("Website").

Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information.

1.2

The products displayed on our Website are a non-binding catalogue of the products we sell and are not an offer to conclude a purchase agreement. By placing an order through the Website, you make a binding offer to purchase the relevant products and offer to conclude a purchase agreement ("Agreement").

We will confirm receipt of your order via email to you ("Receipt Confirmation Email") as soon as possible. An Agreement will be formed when we send you a separate email ("Dispatch Confirmation Email") informing you that the products you have ordered have been dispatched.

1.3

You may only purchase a maximum of 6 products per day and no more than 16 products per week.

2. AGE RESTRICTIONS

2.1

Our products are only suitable for customers aged 12 years and above. By placing an order, you confirm that you are at least 12 years of age. If you are under 18 years of age, you must have parental or guardian consent to purchase our products.

3. PRODUCT SAFETY AND INGREDIENTS

3.1 Safe and Natural Fragrance Oils

All PATALI fragrance oils are formulated with safe and natural ingredients. Our fragrances are completely free from harmful chemicals and substances including:

  • LEAD
  • DBP & DEHP PHTHALATES
  • FORMALDEHYDE
  • ACETONE
  • BENZENE
  • CARBON
  • PETROLEUM
  • PARAFFIN WAX
  • PALM OIL

We are committed to providing safe, natural, and environmentally conscious fragrance solutions that you can use with complete confidence.

4. PAYMENT AND DELIVERY

4.1

We accept payment with:

  • Credit / Debit card (MasterCard, VISA)
  • Apple Pay
  • PayPal

All payments are processed securely through Stripe.

4.2

We are only able to deliver products to addresses within Australia. Products will be delivered within 3-5 working days or within 1-2 working days if you select express shipping.

5. RESALE PROHIBITION

5.1

Our products are sold exclusively for personal use and are strictly prohibited from being resold, distributed, or offered for sale by any customer, third-party retailer, or unauthorised distributor without our express written authorisation.

5.2

Any unauthorised resale, distribution, or commercial use of PATALI products constitutes a breach of these terms and may result in legal action. We actively monitor and investigate suspicious purchasing patterns and unauthorised sales activities.

5.3

Customers found to be in violation of this resale prohibition may have their orders cancelled, accounts suspended, and may be subject to legal proceedings for breach of contract and intellectual property infringement.

6. WARRANTIES AND DEFECTS

6.1

Our goods come with the statutory guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

6.2 PATALI Lifetime Warranty

We provide a lifetime warranty on the visor clip and base/body unit of our vehicle air fresheners against manufacturing defects. This lifetime warranty does not cover fragrance oil, packaging, wool, or decorative plaques, which are covered by a separate 12-month warranty from the date of purchase.

6.3 Defective vs Damaged Products

  • A "defective product" is one that fails to meet quality standards due to manufacturing errors, design flaws, or issues that occurred during the production process while the product was under our control.
  • A "damaged product" is one that has been harmed due to external factors after leaving our manufacturing facility, including but not limited to shipping damage, mishandling, or normal wear and tear.

7. RIGHT TO CHANGE YOUR MIND

7.1

For products bought on our Website you have the right to change your mind and cancel the Agreement within 30 days and receive an exchange provided that the returned products are intact and have not been used by you.

7.2 Right of cancellation

You have the right to change your mind and cancel this Agreement within thirty days, without having to state reasons. The cancellation period is thirty days starting on the day on which you or a third party takes physical possession of the goods.

You must return the goods back to us as soon as possible and in any event within fourteen days of the day on which you inform us of the cancellation. We will pay the direct costs of returning the goods only if the return is due to our error or product defects.

8. FREE RETURNS POLICY

8.1 Eligibility

We offer free returns and exchanges for:

  • Products damaged during shipping
  • Defective products (manufacturing defects)
  • Incorrect items sent due to our error
  • Products that do not match the description provided

8.2 Return Process

To initiate a return:

  1. Contact us immediately with your order number and photos of the damaged/incorrect product
  2. We will provide you with a prepaid return shipping label
  3. Package the item securely in its original packaging (if possible)
  4. We will process your exchange within 5-7 business days of receiving the returned item

8.3 What We Cover

For eligible returns, we will:

  • Provide a prepaid return shipping label
  • Send a replacement product at no additional cost
  • Cover all shipping costs for the replacement item

9. DISPUTE RESOLUTION

We are committed to resolving any disputes fairly and quickly. If you have any concerns or complaints, please contact us directly. We will do our absolute best to ensure we resolve any issue in a timely and satisfactory manner.

10. OTHER IMPORTANT TERMS

These terms are governed by the laws of Australia and you can bring legal proceedings in respect of the products in the courts of Tasmania.

This Agreement is between you and us. No other person shall have any rights to enforce any of its terms.
